These Terms of Service ("Terms") govern your access to and use of the Bookmark website, browser extension, and mobile application (collectively, the "Service") operated by Bookmark ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Your account

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. Notify us immediately at dremfind@gmail.com if you suspect unauthorized access to your account.

You may not share your account with others or use another person's account without their permission.

3. Acceptable use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe the intellectual property rights of others
• Store or transmit malicious code
• Attempt to gain unauthorized access to the Service or its infrastructure
• Interfere with or disrupt the Service or servers connected to the Service
• Scrape or harvest data from the Service using automated means without our permission
• Use the Service to store or distribute content that is illegal, harmful, or abusive

4. Your content

You retain ownership of the bookmarks, notes, and tags you save through the Service. By using the Service, you grant us a limited license to store, process, and sync your content solely to provide the Service to you.

You are responsible for the content you save. We do not review or moderate saved bookmarks, but we reserve the right to remove content that violates these Terms or applicable law.

5. Paid subscriptions

Some features of the Service require a paid subscription. Subscription fees are charged in advance on a monthly or annual basis and are non-refundable except as required by law or as described in our refund policy.

We may change subscription pricing with 30 days' notice. Price changes take effect at the start of your next billing cycle. Continued use of the Service after a price change constitutes acceptance of the new price.

You may cancel your subscription at any time from the Settings page. Access to paid features continues until the end of your current billing period.

6. Service availability

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice.

Because Bookmark is offline-first, your saved bookmarks remain accessible on your device even when the Service is unavailable.

7. Intellectual property

The Service and its original content, features, and functionality are owned by Bookmark and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BOOKMARK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

10. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct we determine is harmful to other users or the Service. You may delete your account at any time from the Settings page.

Upon termination, your right to use the Service ends. We will delete your data within 30 days except where retention is required by law.

11. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Bookmark operates, without regard to conflict of law principles.
